This report presents background information to support the implementation of the 2019 Canadian Human Rights Tribunal (CHRT) 39 order to compensate First Nations children who have been denied the right to stay safely with their families and to receive adequate medical care or social services because of discriminatory policies and practices put in place by the federal government. This report’s findings may help inform the agreements-in-principle (AIP) reached on December 31, 2021. It also discusses opportunities to overcome challenges related to using administrative data. The project aims to minimize the burden on individual claimants to prove their eligibility. The research team was led by Barbara Fallon (University of Toronto) and Nico Trocmé (McGill University) and funded by Indigenous Services Canada (ISC) at the request of the First Nations Child and Family Caring Society. The report builds on the Taxonomy of Compensation Categories for First Nations Children, Youth and Families related to 2019 CHRT 39 (Sistovaris et al., 2019), prepared by the University of Toronto research team.
